Terms of service

What we provide

We generate homeowner roofing enquiries and deliver them to roofing contractors. We are a marketing company. We do not perform roofing work, we do not act as your agent with any insurer, and we are not affiliated with any roofing manufacturer or insurance carrier.

Reserved leads

A “reserved lead” means a homeowner enquiry that we generate against your reservation and assign to your company alone. We commit to four things about it: it is generated by us rather than purchased from a data list; it is delivered to one contractor; it is retired after delivery, so it is never redistributed or resold later as aged data; and it is never reactivated if your subscription ends. We cannot control whether a homeowner independently contacts other contractors on their own initiative, and we make no promise about that.

Duplicates

Every lead delivered to you is listed in your portal, so a duplicate is verifiable on both sides. If we deliver the same homeowner contact to you more than once, tell us and we will replace it. We also stop working a lead once it has been delivered — our team does not call it back.

No refunds on lead packages

Lead packages are not refundable, in whole or in part, once a billing period has begun. We commit to generating and verifying every lead we deliver against our published standard. What a lead becomes after that depends on how quickly it is called, how it is followed up and how it is sold, none of which is within our control.

If a delivered lead does not match what we published, tell us. We want to know, because it means our targeting needs correcting, and we will discuss it with you. A report is not a claim for money back.

No guarantee of results

We do not guarantee that any lead will result in an appointment, a signed contract or revenue. Whether a lead closes depends on your pricing, your response time, your sales process and factors outside anyone’s control. Any figures we show in examples or product screenshots are illustrations, not projections of your results.

Your obligations

• Hold and maintain the licenses, bonds and insurance your state and locality require
• Contact homeowners lawfully, including under the Telephone Consumer Protection Act, any applicable state telemarketing law, and calling-time restrictions
• Honour a homeowner’s request to stop contacting them, promptly and by any means they use to ask
• Use lead data only to pursue the enquiry, and never resell, redistribute or add it to a list
• Keep your account credentials secure and not share seats outside your company

Billing and cancellation

Plans are billed monthly in advance. There is no long-term contract and no setup fee. You may cancel at any time before your next billing date, which stops future billing and releases your reserved cities. Amounts already billed for a month of leads are not prorated. Failed payment may pause delivery and release your area.

Reserved areas

We cap the number of contractors we supply in any given city, and a paid subscription holds your place against that cap for the cities listed on your plan. This is a limit on how many roofers we take on, not a grant of sole rights to an area, and it creates no property right in any geography.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to these terms is limited to the amounts you paid us in the three months before the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business, even if we were advised of the possibility.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or wilful misconduct.

Indemnity

You will indemnify us against claims arising from your contact with homeowners, your roofing work, your representations to homeowners, and your failure to hold required licenses or insurance.

Changes to these terms

We may update these terms and will change the date above. If a change materially reduces what you receive, we will give notice before it applies to your next billing period.

Governing law

These terms are governed by the laws of the state in which DFW Roof Connect LLC is organized, without regard to conflict-of-laws rules.
